I took some time to look at the issue you are experiencing. It looks like a bug, so I have logged this with our developers as Development Issue 69905.

Hi Daniel,
The issue was fixed back in 2011. I've tested it out and it seems to behave as expected in the scenario of the issue submitted.
I've attached the sample application so you could check if your scenario is really the the same.
