ClearDataSource call causes Multiple controls with the same ID error

I updated to 2010.3 SR 2056 today and this problem still exists - I don't understand why it cannot be fixed - I have no illusion that it is hard to find out - I am providing the markup for the webdatagrid in hopes that you can recreate it in a test solution and test async postbacks and rebinds.
